TERMS AND CONDITIONS

1Bataan Integrated Transport System Inc.


  1. RESERVATION POLICY
    1. I/We am/are aware that I/we can book my/our trips:
      1. Online at www.its.1bataan.com;
      2. Directly at 1Bataan ITS Terminals;
      3. Through e-mail at its@1bataan.com; or,
      4. Through the 1Bataan ITS Reservations team ("Reservations Team") hotline.
    2. I/We understand that bookings shall be subjected to trip schedule & seat availability.
    3. I/We understand that I/we can book reservations online on or before one (1) hour prior to my/our date of departure if I/we pay using credit/debit cards. Furthermore, I/we am/are aware that I/We should pay using credit/debit cards within fifteen (15) minutes from booking. Otherwise, failure to settle the payment on time shall result in forfeiture of my/our reservation/s and assignment of seat/s to other customers.
    4. I/We understand that I/we can book reservations online on or before seventy-two (72) hours prior to my/our date of departure if I/we pay using other payment channels. Furthermore, I/we am/are aware that if I/we should pay on authorized Dragonpay payment centers within forty-eight (48) hours from booking. Otherwise, failure to settle the payment on time shall result in forfeiture of my/our reservation/s and assignment of seat/s to other customers:
    5. I/We understand that I/we can book reservations through e-mail or phone on or before seventy-two (72) hours prior to my/our date of departure if I/we pay using other payment channels. Furthermore, I/we am/are aware that if I/we should pay for my/our reservation within twenty-four (24) hours from booking. Otherwise, failure to settle the payment on time shall result in forfeiture of my/our reservation/s and assignment of seat/s to other customers. I/We should send proof of payment (i.e. deposit slip) to the Reservations Team within the period specified in Section 1.c.ii.1 herein.
    6. I/We understand that I/we shall only be allowed to book my/our trip directly at 1Bataan ITS Terminals, for reservations within two (2) days from date of departure and same-day bookings. Furthermore, I/we may book trips in advance on 1Bataan ITS terminals, subject to ticket pricing conditions in Section 3.b hereinafter.
    7. Moreover, I/we am/are aware that if I/we book directly at 1Bataan ITS Terminals:
      1. I/We should pay immediately upon reservation; and,
      2. Such bookings shall automatically invalidate me/us of privileges such as payment refunds and rebooking, except when:
        1. I/We booked on the Terminals in advance, but cancelled my/our trip on or before five (5) days prior to my/our departure date; or,
        2. My/Our trip has been cancelled for circumstances mentioned in Section 7.e hereinafter.
    8. I/We understand and agree that my/our Reservation/s & Ticket/s is/are non-transferable.

  2. TICKET VALIDITY
    1. I/We understand that tickets shall only be valid on the time & date of the ferry departure schedule.
    2. Ticket validity may be applied on other schedules only if I/we shall meet conditions stated in Section 8 hereinafter.

  3. TICKET PRICING CONDITIONS
    1. I/We am/are aware that all ticket rates are in Philippine Peso.
    2. I/We know that the default ticket prices are the following:
      1. ₱ 450.00 for tickets purchased online; and,
      2. ₱ 799.00 for tickets purchased in 1Bataan ITS Terminals (i.e. advanced booking and same-day booking of trips) and through the Reservations Team (e-mail or phone).
    3. I/We understand that Senior Citizens and Persons with Disabilities (PWD) shall be eligible to a twenty percent (20%) discount on ticket prices. However, I/we am/are aware that:
      1. This shall only apply for walk-in clients who availed a regular priced ticket, and for clients who booked through e-mail or through phone;
      2. This shall not apply for clients who booked online, or who availed tickets priced at promo rates;
      3. This shall not be given without provision of any valid proof that the individual is a Senior Citizen or a PWD; and,
      4. This discount shall not apply with ticket/s of his/her companions, except if his/her companion/s is/are also Senior Citizen/s or PWD/s as validated by 1Bataan ITS personnel.
    4. I/We understand that children aged 2 years old and below shall be free of charge, for as long as the child shall sit on my/our lap.
    5. However, I/we understand that I/we am/are responsible for informing 1Bataan ITS that I/we are travelling with an infant. Non-disclosure or failure to disclose such information may be grounds for 1Bataan ITS to refuse my/our boarding, as specified in Section 10.c hereinafter.
    6. I/We understand that 1Bataan ITS reserves the right to adjust ticket rates without prior notice.

  4. CUSTOMER IDENTIFICATION POLICY
    1. Online Reservations
      1. I/We shall disclose required information in the 1Bataan ITS online portal, and I/we know that I/we should receive an e-Ticket and an Official Receipt from 1Bataan ITS signifying that my/our booking has been successfully completed.
      2. I/We understand that I/we should present the e-Ticket and the Official Receipt (either a printout or a softcopy saved in gadgets such as smartphones, tablets or laptops), together with my/our valid identification documents and/or proof of payment (i.e. credit card, deposit slip, etc.) to 1Bataan ITS personnel in the Terminal.
      3. I/We am/are cognizant that when someone paid for my/our behalf ("Payee"), I/we should submit an Authorization Letter to 1Bataan ITS signed by the Payee with a photocopy of my/our and his/her valid identification documents. Exception to this rule is when the Payee is physically present at the Terminal to join me/us in the trip.
      4. I/We understand that a Boarding Pass shall be given to me/us by 1Bataan ITS personnel bearing my/our names, seat assignment and trip schedule. I/We should present it to 1Bataan ITS personnel upon boarding. Otherwise, I/we shall not be allowed to board on the ferry and/or bus.
    2. Walk-in Reservations
      1. I/We shall disclose required personal information to 1Bataan ITS personnel such as but not limited to full name, age and contact number, in compliance with Philippine Coast Guard (PCG) requirements.
      2. Likewise, I/we should present valid identification documents to 1Bataan ITS personnel to authenticate my/our identity.
      3. I/We understand that a Boarding Pass shall be given to me/us by authorized 1Bataan ITS personnel bearing my/our names, seat assignment and trip schedule. I/We should present it to 1Bataan ITS personnel upon boarding. Otherwise, I/we shall not be allowed to board on the ferry and/or bus.
    3. E-mail & Phone Reservations
      1. I/We shall fully disclose required information to the Reservations Team, such as but not limited to the following:
        1. Full name/s of passenger/s;
        2. Age of passenger/s;
        3. Date of travel;
        4. Point of origin and destination;
        5. Trip schedule;
        6. Mobile number of passenger/s;
        7. E-mail address/es of passenger/s; and
        8. Complete address/es of passenger/s.
      2. I/We should deposit my/our payment in the nominated 1Bataan ITS Bank Account so that I/we can obtain my/our Reservations ID. Failure to pay or payments made past the cut-off mentioned in Section 1.c.ii.1 herein shall forfeit my/our reservation/s.
      3. I/We am/are aware that I/we shall submit a deposit slip validated by the Bank to the Reservations Team to get an e-mail confirmation containing my/our Reservation ID/s.
      4. I/We am/are aware that I/we shall present my/our Reservation ID/s with my/our valid identification documents and/or proof of payment to 1Bataan ITS personnel in the Terminal.
      5. I/We understand that a Boarding Pass shall be given to me/us by authorized 1Bataan ITS personnel bearing my/our names, seat assignment and trip schedule. I/We should present it to 1Bataan personnel upon boarding. Otherwise, I/we shall not be allowed to board on the ferry and/or bus.

  5. BOARDING/CHECK-IN GUIDELINES
    1. I/We am/are aware that I/we can check-in an hour and a half (1.5) hours prior to my/our ferry departure schedule.
    2. I/We am/are cognizant that the Boarding Gates shall close thirty (30) minutes prior to departure, for PCG clearing requirements.
    3. I/We understand that failure to board or to check-in thirty (30) minutes prior to departure shall forfeit my/our reservations, invalidating privileges such as rebooking of my/our trip or receiving refunds.

  6. BAGGAGE & CARRIAGE CONDITIONS
    1. I/We am/are aware that a standard routine baggage checking shall be done in terminals for security. Furthermore, I/we am/are solely responsible for securing my/our handheld luggage and shall hold 1Bataan ITS free from any liabilities arising from lost or damaged handheld luggage.
    2. I/We understand that I/we can only carry one (1) handheld luggage inside the ferry with a maximum weight of seven (7) kilograms, and maximum size of 56cm (22 in.) x 36cm (14 in.) x 23 cm (10 in.).
    3. I/We am/are aware that passengers carrying luggage exceeding specifications in Section 6.b may be accommodated. However, I/we am/are cognizant that 1Bataan ITS reserves the right to decline boarding of passengers carrying excess baggage or big packages.
    4. I/We also know that 1Bataan ITS reserves the right to refuse my/our accommodation for bringing pets or bringing flammable, hazardous or illegal substances inside the terminal or inside the vehicle.

  7. CANCELLATION POLICY
    1. I/We may request to cancel my/our trip by sending an e-mail message at its@1bataan.com, justifying my/our reasons for the cancellation. However, trip cancellation may either invalidate my/our privileges or me/us be subjected with cancellation fees.
    2. Booking online, Over-the-Counter or through the Reservations Team shall signify my/our commitment to join the trip. However, cancelling trips owing to these instances shall automatically forfeit my/our privileges of refund & rebooking trips:
      1. If I/we booked directly on 1Bataan ITS Terminals on the same day, or if I/we booked in advance on Terminals but cancelled it within four (4) days prior to my/our date of departure;
      2. If I/we were tagged as a "No Show" in my/our trip for failure to board the ferry for reasons not mentioned in Section 7.e hereinafter;
      3. If I/we cancelled any trips labeled as non-refundable, non-cancellable, trips under a promo, or any other similar terms; or,
      4. Any other reason/s deemed by 1Bataan ITS management that will invalidate my/our privileges.
    3. If I/we cancelled my/our reservations on or before five (5) calendar days prior to my/our scheduled trip, I/we am/are aware that I/we shall be charged with a cancellation fee of fifty percent (50%) of the total amount paid.
    4. On the other hand, cancellation of bookings from four (4) calendar days prior to day of my/our departure up to the day of my/our trip shall charge me/us with a cancellation fee of one hundred percent (100%) of the total amount paid.
    5. I/We shall only be entitled with rebooking & refund privileges mentioned in Sections 8 and 9 for the following reasons:
      1. If my/our trip has been cancelled due to fortuitous events or force majeure which prompted 1Bataan ITS, PCG, or any relevant local/national transport regulatory agencies to cancel the trip; or,
      2. If such entities had outright declared an announcement that my/our trip has been cancelled.
    6. Pursuant with Section 7.e herein, I/we am/are aware that 1Bataan ITS may contact me/us or any other passengers through e-mail, phone or any other available media regarding changes in trip schedule, trip cancellations or any other important notice.

  8. REBOOKING POLICY
    1. I/We may request to rebook my/our trip by sending an e-mail message at its@1bataan.com, justifying my/our reasons for the need to rebook the trip.
    2. I/We am/are aware that:
      1. Rebooking should be properly arranged with 1Bataan ITS, and failure to agree on rebooking dates may constitute a refund;
      2. Rebooking shall be subjected to trip schedule & ferry seat availability;
      3. Rebooking should be only done on or before five (5) days prior to the departure date;
      4. Rebooking shall only be made once.
      5. New trip schedule should not exceed thirty (30) days after the original departure date.
    3. I/We understand that the rebooking fee shall be paid in cash at the 1Bataan ITS Terminal on the new departure date
    4. I/We know that rebooking fees shall only be waived if the reason behind the change in trip schedule falls under provisions set forth in Section 7.e herein.

  9. REFUND POLICY
    1. I/We understand that refunds shall be issued to me/us only after rebooking arrangement efforts with 1Bataan ITS have been exhausted.
    2. I/We am/are aware that rebooking fees shall depend on the reason of the trip cancellation and the date the request was made:

    4. I/We am/are aware that 1Bataan ITS shall only issue payment refunds when:
      1. If I/we have cancelled my/our reservations on or before five (5) calendar days prior to my/our scheduled trip, pursuant with Section 7.c herein.
      2. If my/our trip has been cancelled due to events mentioned in Section 7.e herein, but I/we either refused to rebook my/our trip or have not met in agreement with 1Bataan ITS of a new trip schedule arising from time constraints, personal reasons or any other reasons pursuant with Section 9.a herein.
    5. I/We am/are aware that refunds shall depend on the reason of the trip cancellation and on when did I/we made the cancellation request:

    7. I/We understand that if I/we shall be entitled to payment refunds, generally I/we shall receive the compensation based on the mode of payment that I/we used to purchase ticket/s or to book an online confirmation and based on the reason why my/our trip has been cancelled.
    8. I/We am/are also aware that 1Bataan may issue refunds through check issuance or by crediting funds in my/our nominated bank account number fifteen (15) days after the date of my/our trip schedule, regardless of mode/s of payment used to purchase ticket/s or to book an online confirmation.

  10. RIGHT OF REFUSAL OF ACCOMMODATION
    1. I/We understand that 1Bataan ITS reserves the right to refuse my/our accommodation for non-compliance or for failure/refusal to comply with the provisions indicated herein, or for causing 1Bataan ITS to violate its compliance with pertinent government regulations & laws.
    2. I/We am/are also aware that 1Bataan ITS may refuse boarding of anyone posing security & safety risks to other passengers, 1Bataan ITS personnel and government authorities during check-in at the ferry terminals or onboard.
    3. I/We know that 1Bataan ITS refuses boarding of pregnant women in the ferry for safety reasons. Likewise, I/We know that 1Bataan ITS may refuse boarding of passengers with infants if their guardians/parents failed to disclose them to 1Bataan ITS personnel, or if they would breach the maximum allowed count of six (6) infants per trip.
    4. I/We also understand that 1Bataan ITS may rescind my/our confirmed reservation or may prevent anyone from boarding the ferry if 1Bataan ITS has proof that someone had reserved a trip online using fraudulent credit or debit cards.
    5. To reiterate Section 6.d herein, 1Bataan ITS reserves the right to refuse my/our boarding for bringing pets or flammable, hazardous and illegal substances inside the terminal or vehicle.

  11. TERMS OF USE
    1. By accessing or using the 1Bataan ITS website, or by purchasing of tickets from other 1Bataan ITS reservation channels, it is understood that I/we are bound to have completely read, understood and agreed with the Terms of Conditions specified herein.
    2. I/We understood that non-compliance with the provisions stated herein shall result in my/our revocation from using 1Bataan ITS services.
    3. I/We am/are aware that 1Bataan ITS reserves the right to update & change the Terms & Conditions from time to time without prior notice.

  12. INDEMNIFICATION CLAUSE
  13. I/We hold 1Bataan ITS and its Directors, officers, employees, and stockholders free & harmless from all liabilities, claims, actions, suits, demands, damages, obligations, losses, settlements, judgements, costs and expenses which arise out of, or relate to or result from my/our negligence or willful misconduct.
